I take your privacy very seriously, so it is important to me that you feel safe when contacting me or using my website. In my dealings with you, for example if you send me a message, or purchase from me, I do need to process information about you. I may for example have your name, email and delivery address etc. so that I can fulfil your requests.

By using my site, you consent to such processing and you warrant that all data provided by you is accurate, and in return, I will do everything reasonably practicable to ensure the details you give me remain private and secure.

This policy sets out the basis on which I, Rosemarie O’Leary in the conducting of my Fine Art business, will process any personal data you provide me with in the course of using my website, www.rosemarieoleary.com, or through direct personal contact, in accordance with the UK Data Protection Regulations 2018 and EU General Data Protection Regulations (GDPR)

When you contact me, whether through my website, or personally, there are a number of ways in which you provide information and other data to me.

 

I need this information to: -

Carry out my obligations arising from any contracts entered into between you and me, for example when you place an order or request more information from me, I need your personal details to be able to respond.

Where you have requested or consented to be included in a promotional mailing list or Newsletter. I will send you an occasional newsletter, promotional or update emails on new projects. I do not spam my customers and there will always be an ‘unsubscribe’ or ‘opt out’ option for you which you can do at any time.

 

Data Storage

All information you provide to me is stored on my secure computer/hosting servers and secure files.

Email/newsletter subscribers will be deleted immediately if you decide to unsubscribe. This information may be your name and email address.

Customers who purchase from me – I will normally retain your details for a maximum of 6 years. This is so that I have a record of original paintings sold and reproduction prints issued where guarantees of the quality of my work are standard. I use only the finest quality archival art materials and my art work should under normal circumstances last many lifetimes. Under Customers Rights though, customers may request explicitly that their personal details be deleted from my records. I will do this immediately and anonymise the sales record.

 

Payment Transaction Information for Purchases
Any payment transactions for purchases of items or services will be encrypted (Secure SSL technology – my website shows a secure padlock in the URL address). The payment processing service for my website is Paypal. Paypal are a global payment processing company and provide their own secure checkout, and my site will not have access to your card payment details at any time. The information I will have will be your name, address and contact details, the item(s) or services you purchased and your email address if you subscribe to updates for example on promotional offers or a newsletter. If you do subscribe, there will always be an option for you to unsubscribe at any time.

Payment Transaction Information for Purchases Made in Person. For example, a customer purchases a painting during a visit to my studio or an Art Fair where I am displaying a stall.
I accept Debit and Credit cards through iZettle, another third party global and secure payment gateway which means I do not have access to any card details, or other information you do not wish to give. Confidential card details are retained by iZettle. I am given confirmation of the amount of payment made by name only.

 

Customer Rights
As a sole trader, I am the Data Controller. Customers and subscribers have the right to request exactly what information I may hold about them and how this is held. I will always do my utmost to respond promptly and accurately.

Customers also have the right to request that all their personal details be deleted from my records. Upon such a request and where all purchasing obligations have been satisfactorily fulfilled, this will be actioned immediately and confirmed.

 

Disclosure of your Information
I will not disclose your personal information to any other persons or companies without your express permission. The only exception would be where I am legally obliged to in order to comply with organisations in connection with crime or fraud protection.

Your privacy is very important to me, and I will take all reasonable steps to protect your personal data.

Please note that if you click on or follow any links from my site to other external websites, my privacy policy will no longer apply. Please check the privacy policies of any such other external site before submitting any personal data, as I cannot accept any responsibility or liability in relation to them.

 

In the event of a data breach
As mentioned previously, full security measures are in place to keep all of your data safe. However, in the event of any breach, I will immediately inform you of what details have been compromised and when this happened. I will also confirm what extra measures have been put in place to ensure no further breaches take place.
